Unused classes will be forfeited after their date of expiration.
Assumption of the Risk, Hold Harmless and Waiver of Claims
WHEREAS, the novel coronavirus, COVID19, has been declared a worldwide pandemic by the World Health Organization; and
WHEREAS, COVID19 is extremely contagious, can lead to severe illness and death, and is believed to spread mainly from person to person contact; and
WHEREAS, an inherent risk of exposure to COVID19 exists in any public place where people gather.
THEREFORE, I agree to adhere by the following guidelines for attending any and all in person FIT4MOM Richmond (“FIT4MOM”) or STROLLER STRIDES, LLC (“STROLLER”) classes:
1) Class attendance is conditioned on my being healthy. I will not attend class if I am not feeling well, have recently not been feeling well, and/or have any fever or symptoms of illness. I understand that FIT4MOM and STROLLER will rely on my representations in this regard, and I hold them harmless and will indemnify them for any claims made against them as a result of my breach of this condition.
2) I understand that each attendee must bring her own mats and fitness equipment, which must be sanitized before each class. I understand that FIT4MOM and STROLLER will rely on my representations in this regard, and I hold them harmless and will indemnify them for any claims made against them as a result of my breach of this condition.
3) I agree to maintain at least ten (10) feet of distance from all other class participants and the instructor. I understand that FIT4MOM and STROLLER will rely on my representations in this regard, and I hold them harmless and will indemnify them for any claims made against them as a result of my breach of this condition.
4) I will have a mask on hand should I choose to wear one while I am arriving at, attending, and leaving class or if for any reason social distant requirements cannot be met. I understand that FIT4MOM and STROLLER will rely on my representations in this regard, and I hold them harmless and will indemnify them for any claims made against them as a result of my breach of this condition.
Although FIT4MOM and STROLLER have taken preventative measures to reduce the spread of COVID19 during its classes, it cannot guarantee that you and/or your child will not become infected with COVID19 as a result of being at such classes. Attending in person classes increases your risk and your child’s risk of contracting COVID19. By signing this agreement, you acknowledge the contagious nature of COVID19 and voluntarily assume the risk that you and/or your child may be exposed to, or infected by, COVID19 by attending in person classes, and that such exposure or infection may result in injury, illness, permanent disability, and/or death. You agree to assume all risk of attending said classes, and agree to hold FIT4MOM and STROLLER, their employees, agents, and representatives, harmless and indemnify them for any injury, illness, disability, and/or death you or your child may suffer as a result of attending said class, from whatever cause, including but not limited to, any action, omission or negligence of FIT4MOM and STROLLER, their employees, agents and/or representatives, or other attendees of said class. I am releasing any and all claims, demands, rights or causes of action, in law or equity, whether civil, tortious, criminal or otherwise, that I may have as a result of attending said classes.
By signing below I acknowledge that I am agreeing to the provisions of this document of my own accord and without any coercion or pressure of any kind. I have carefully read it and had all of its provisions explained to me fully and satisfactorily, and my questions answered to my satisfaction. I have given due consideration to all the provisions of this document and understand them clearly. I am signing it freely and voluntarily. I understand that I am giving up legal rights and remedies that might be otherwise available to me, and that it is binding upon me, my heirs, administrators, executors, trustees, assigns and successors-in-interest.
I am 18 years of age or older and legally competent to sign this document.
